Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The warranty described on this page is in addition to any other rights and remedies you have under the Australian Consumer Law (ACL) and other laws. Nothing in this policy excludes, restricts or modifies those rights. Where this policy and the ACL differ, the ACL applies.
What is covered and for how long
E-Tech Marine warrants that products we sell will be free from defects in materials and workmanship (manufacturing defects) that appear within 12 months from the date of delivery to you (or the date you collect the goods), when used for normal private, recreational purposes and in line with the manufacturer's instructions.
When this warranty ends, you may still have rights under the Australian Consumer Law. The consumer guarantees last for a reasonable time, which depends on the product and can be longer than 12 months.
What we will do (non-major failures)
If a product has a manufacturing defect that is not a major failure, we will choose how to fix it. In most cases we will remedy the problem in this order:
- Replacement parts: we send you genuine replacement spare parts free of charge, for fitting by you or by a local repairer;
- Repair: if supplying parts is not suitable, we arrange for the product to be repaired;
- Replacement: if the product cannot be repaired within a reasonable time, we replace it with the same or an equivalent product.
Under the ACL, a minor failure must be fixed free of charge. If we cannot or do not remedy a non-major failure within a reasonable time, you may be entitled to have it fixed elsewhere and recover the reasonable cost from us, or to a refund or replacement.
Major failures
If the failure is a major failure under the ACL, you can choose a refund or a replacement, and you may also be entitled to compensation for reasonably foreseeable loss or damage. This policy does not limit that choice.
What this warranty does not cover
To the extent permitted by law, this voluntary warranty does not cover:
- damage caused by misuse, abuse, neglect, overloading, accidents, impact or grounding;
- normal wear and tear – for example tube abrasion, scuffing, fading or UV deterioration of fabrics and tubes, and worn or damaged propellers;
- corrosion caused by saltwater where the product has not been flushed, cleaned, stored or maintained as the manufacturer recommends;
- damage caused by not following the manufacturer's operating, installation, servicing or storage instructions;
- damage caused by modifications, or by repairs carried out by anyone not authorised by us or the manufacturer;
- products used for commercial, hire, rental or charter purposes;
- incidental or consequential losses (such as loss of use, travel costs or lost time), except where the law does not allow these to be excluded.
These exclusions apply only to this voluntary warranty. They do not limit your rights under the Australian Consumer Law, including your right to compensation for reasonably foreseeable loss or damage where goods fail to meet a consumer guarantee.
How to make a claim

- Provide proof of purchase (order number or receipt), the product name and serial number if it has one, a description of the problem, and clear photos and/or video showing the defect.
- We will assess the claim and may ask for more information or for the product to be inspected by us or an authorised agent.
- If the claim is accepted, we will arrange the remedy described above.
The defect must appear within the 12-month warranty period, and you should contact us as soon as reasonably possible after you notice it. We may ask to inspect the product before deciding on a remedy.
Who pays the costs of a claim
Unless the law requires otherwise, you are responsible for the cost of sending the product (or the faulty part) to us or our nominated repairer, and for any removal and re-installation costs. We pay to send repaired or replacement goods or parts back to you within Australia.
However, under the Australian Consumer Law:
- if we confirm the product has a fault covered by the consumer guarantees, we will reimburse your reasonable costs of returning it;
- if the product is large, heavy or hard to return (for example a boat or outboard motor), we will arrange and pay for its collection or transport within a reasonable time;
- if we inspect the product and find no fault covered by the warranty or the consumer guarantees (for example, damage caused by misuse), we may charge you the reasonable cost of collection and inspection – but we will give you a reasonable estimate of those costs before we collect it.
How to claim your expenses: email copies of your receipts (postage, freight or other reasonable claim costs) to sales@e-techmarine.com.au with your order number. Approved expenses are reimbursed to your nominated bank account or original payment method.
